Terms of Service

1. Acceptance of Terms

By creating a SMS Locker™ account or using the SMS Locker desktop, mobile, or web applications (collectively, the “Service”), you agree to be bound by these Terms of Service (the “Terms”) and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

SMS Locker™ is a software product that imports and stores text messages, voicemails, attachments, and contacts from iPhone backups onto your own device, with optional cloud sync to your private SMS Locker account. The Service is provided by SMS Locker, LLC (“we,” “us,” or “our”).

3. Account & Eligibility

You must be at least 13 years old to create an account. You are responsible for the confidentiality of your password and for all activity under your account. We require email-based authentication and recommend enabling two-factor authentication.

4. Trial & Subscription

New accounts include a 7-day free trial of the full Service. Continued use after the trial ends requires an active paid license. Payment, refund, and cancellation terms are described at the point of purchase. We may end the trial early if we detect abuse or fraudulent activity.

5. Your Data

You retain all rights to the messages, voicemails, attachments, and contacts you import or sync (“Your Data”). You grant us only the limited license necessary to operate the Service for you — store, transmit between your devices, and back up Your Data. We do not sell, rent, or share Your Data with third parties.

You may export Your Data at any time from the Account page (Download my data). You may permanently delete your account and Your Data from the same page. See the Privacy Policy for details.

6. Acceptable Use

You agree not to:

• Use the Service to import or sync content you do not have lawful rights to.
• Reverse-engineer, modify, or attempt to derive source code from the Service.
• Resell, sublicense, or redistribute the Service without our written permission.
• Use the Service to harm, harass, or violate the privacy of others.
• Bypass authentication, rate limits, or device-count restrictions.

7. Intellectual Property

SMS Locker™, the SMS Locker logo, and all software, designs, and documentation are owned by SMS Locker, LLC and are protected by copyright and trademark law. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use.

8. Termination

You may terminate your account at any time. We may suspend or terminate accounts that violate these Terms, that have an unpaid balance, or that are involved in fraud or abuse. Upon termination, Your Data on our servers will be deleted in accordance with our Privacy Policy.

9. Disclaimer & Limitation of Liability

The Service is provided “as is” and “as available” without warranty of any kind. To the maximum extent permitted by law, SMS Locker, LLC is not liable for any indirect, incidental, special, or consequential damages, including loss of data, even if advised of the possibility. Our total liability is limited to the amount you paid us in the 12 months before the claim.

We do not guarantee that the Service will be uninterrupted, error-free, or that data will not be lost. You are responsible for maintaining independent backups of important data.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in-app and require renewed acceptance before continued use.

11. Governing Law

These Terms are governed by the laws of the United States and the state in which SMS Locker, LLC is registered, without regard to conflict-of-laws principles.
